Current State of Cannabis: Ontario’s Cannabis Law

On December 12, 2017, Ontario passed its own legislation, Cannabis Smoke-Free Ontario, and Road Safety Statute Law Amendment Act, 2017, to complement and transition to the federal Cannabis Act.
According to the Ministry of the Attorney General, Ontario’s Cannabis Act does the following:
•Creates a provincial retailer with about 150 standalone stores and online operations, overseen by the Liquor Control Board of Ontario and as its subsidiary which is branded as Ontario Cannabis Retail Corporation.
•Sets a minimum age of 19 to buy, possess, use and cultivate cannabis in Ontario. This is identical to tobacco and alcohol use and sale in Ontario.
•Bans cannabis use much the same way alcohol is banned in public, at workplaces, or in motor vehicles. In short, you will only be able to use recreational cannabis in a private residence. Those authorized to use medical cannabis will be subject to the same smoking and vaping rules as tobacco and electronic cigarette users.
•Provides for education and prevention programs as a diversion from the juvenile justice system.
•Regulates the smoking and vaping of medical cannabis.
•Provides strict penalties for illegal storefronts and sales channels.
•Strengthens existing drug-impaired driving laws.
Cannabis in Ontario Highlights
•Legal age: 19+
•Possession: Up to 30 grams of dried cannabis
•Home cultivation: Up to four marijuana plants per residence
•Public use: No; restricted to private residential use
•Where to buy cannabis in Ontario: Ontario Cannabis Retail Corporation stores and Ontario Cannabis Retail Corporation online stores. 40 retail stores and online distribution are expected to be opened by July 2018 with 80 retail stores open by July 2019 and 150 retail stores open by 2020.
